ORDINANCE #492

A RESOLUTION OF THE TOWN OF YACOLT, WASHINGTON, ACCEPTING A TEN PERCENT ANNEXATION PETITION FOR CERTAIN PROPERTIES LOCATED AT THE 26612 NE HOAG ST, TAX PARCEL #229641000, REPEALING RESOLUTION #470.

WHEREAS, the Town Council of the Town of Yacolt, Washington is in regular session this 16^TH day of April, 2012; and

WHEREAS, the members of the Town Council have had notice of the time, place, and purpose of said meeting;

WHEREAS, it is the intent of the Town of Yacolt to annex the following parcels:

The parcel #229641000, The North half of the Southeast quarter of the Northeast quarter of Section 2, Township 4 North, Range 3 East of the Willamette Meridian;

Except any portion lying within Public Roads or Highways. 

Except easements of record.

Together with and subject to a non exclusive easement for ingress, egress, and utilities over, under, and across both a strip of land 60 feet in width, the Northerly boundary of which is described as follows:

            Beginning at the Northeasterly right of way line of Clark County’s Lewis and Clark          Railroad crossing at Hoag Street; thence Easterly along the North boundary of the South

            Half of the South half of the North of Section 2, to a point 60 feet East of the West line of           the Southeast quarter of the Northeast quarter of Section 2; all in Township 4 North,   Range 3 East of the Willamette Meridian.

Also subject to the MCI Telecommunications Corporation Site Lease dated October 22, 1984, and recorded as Auditor’s Recording Number 840290018, Pages 38-45; and amendment no. 1 dated September 23, 1985 and recorded as auditor’s Recording number 8510240040, pages 27-34 and amendment no. 2 dated February 24, 2987, and recorded as auditor’s Recording Number 870505018, pages 50-56; and amendment no. 3 dated July 20, 1987, and recorded as auditor’s Recording Number 8710070183, pages 356-362; and Amendment No. 4 Dated May 20, 1988 and recorded as Auditor’s Recording Number 8807110010, pages 31-36;

WHEREAS, we the undersigned, being the owners of real property within the area described which lies outside the corporate limits of the Town of Yacolt, Washington, but contiguous thereto, having an assessed value in excess of 10% if the total value of the said described area according to the assessed valuation for general taxation purposes, do hereby declare our intention to circulate a petition for annexation to the Town of Yacolt, Washington.  It is acknowledged that this petition may consist of multiple documents filed independently.

NOW THEREFORE BE IT RESOLVED, by the Town Council of the Town of Yacolt, Washington that the Town of Yacolt precedes with annexing the above described property.
